1. Acceptance of Terms
By downloading, installing, or using Nurse Wellness Playbook ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.
2. Description of Service
Nurse Wellness Playbook is a wellness and self-care application designed for nurses and healthcare professionals. The App provides tools for:
- Daily wellness check-ins and mood tracking
- Guided breathing and grounding exercises
- Journaling and reflection prompts
- Wellness tracking (sleep, hydration, nutrition)
- Self-assessment questionnaires
- Educational wellness content
3. Medical Disclaimer
IMPORTANT: Nurse Wellness Playbook is NOT a medical device, medical treatment, or substitute for professional medical advice, diagnosis, or treatment.
The App is intended for general wellness and self-care purposes only. The self-assessment tools (including PHQ-9 and GAD-7 questionnaires) are for informational and educational purposes and should not be used to self-diagnose any medical or mental health condition.
If you are experiencing a mental health crisis or emergency, please contact emergency services (911), the National Suicide Prevention Lifeline (988), or go to your nearest emergency room.
Always seek the advice of your physician, mental health professional, or other qualified health provider with any questions you may have regarding a medical or mental health condition.
4. User Responsibilities
By using the App, you agree to:
- Use the App only for its intended wellness and self-care purposes
- Not rely on the App as a substitute for professional medical or mental health care
- Seek professional help if you are experiencing serious mental health symptoms
- Keep your device and the App secure to protect your personal data
5. Intellectual Property
The App, including all content, features, and functionality, is owned by Kevin Foster and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without prior written consent.
6. Subscriptions and Payments
Some features of the App may require a paid subscription. If you purchase a subscription:
- Payment will be charged to your Apple ID account at confirmation of purchase
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage and cancel your subscriptions in your Apple ID account settings
- No refunds will be provided for partial subscription periods
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NURSE WELLNESS PLAYBOOK AND ITS DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PERSONAL INJURY, OR EMOTIONAL DISTRESS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.
The App is provided "as is" without warranties of any kind, either express or implied.
8. Indemnification
You agree to indemnify and hold harmless Kevin Foster and Nurse Wellness Playbook from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
9. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the App after changes constitutes acceptance of the modified Terms.
10. Termination
We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the App.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Massachusetts, without regard to its conflict of law provisions.
